Terms & Conditions

These Terms & Conditions apply to bookings for Miner’s Cottage and Damson Cottage, Coniston (collectively referred to as “the cottages” and individually as “the property”).

CONTRACT

The contract for a short-term holiday rental will be between the owners of Miner’s Cottage and Damson Cottage (referred to as “us” or “we”) and the person making the booking (referred to as “you” or “your”) under the following booking conditions.

The person making the booking confirms that they are authorised to make the booking on behalf of all guests, must be over 18 years of age and agrees to take responsibility for the property and the payment of any rental fees or damages.

You are responsible for ensuring that everyone staying at the property is aware of and complies with these Terms & Conditions.

At the time of booking, you will be asked to provide your full name and address and the total number of guests staying.

PAYMENT

A 30% deposit is required on booking via bank transfer or cheque.

The remaining balance is payable six weeks before the start of your stay.

If a booking is made less than six weeks before arrival, the full rental charge must be paid at the time of booking or as soon as your reservation has been confirmed.

Failure to pay the outstanding balance by the due date may result in the booking being cancelled and the property being made available for re-booking.

CANCELLATION

A booking is confirmed on acknowledgement of a non-refundable deposit.

Payment of the remaining balance is due six weeks before your holiday start date. Failure to pay the balance may result in cancellation of your booking.

We strongly recommend that guests take out suitable UK travel insurance to protect against cancellation due to illness, family emergencies, travel disruption and other unforeseen circumstances.

CANCELLATION BY US

If we have to cancel your booking for any reason, including circumstances beyond our reasonable control, you will be refunded all monies paid to us.

Our liability will be limited to the amount of deposit and/or rental payments you have paid.

CANCELLATION BY YOU

If you cancel because you are unable or no longer wish to travel, this will normally remain at your own risk and does not automatically give rise to a right to a refund.

Where possible, we will attempt to re-let the property.

If you choose not to take out suitable UK travel insurance, you accept responsibility for any financial loss resulting from your cancellation.

REFUNDS

Where a cancelled stay is successfully re-let, any refund will be based on the amount received from the replacement booking, which may be less than the amount originally paid.

A £50 administration fee will be deducted to cover costs associated with cancellation and re-booking.

TRAVEL INSURANCE

We strongly recommend that guests take out appropriate travel insurance that includes cancellation and curtailment cover.

It is your responsibility to ensure that your chosen policy provides suitable cover for your circumstances.

TERMS OF USE

Guests should not arrive before 3:00pm on the arrival day and must leave the property by 10:00am on the departure day unless otherwise agreed.

Failure to leave by the agreed departure time may result in an additional charge.

The property must only be used as self-catering holiday accommodation during the booked holiday period.

Your stay does not create a landlord and tenant relationship or any form of tenancy.

On departure, the property must be left in a clean and tidy condition.

USE OF THE PROPERTY

The number of guests staying at the property must not exceed the maximum occupancy stated for the cottage on our website, unless agreed with us in advance.

We reserve the right to refuse admittance or terminate a stay if this condition is not observed.

The property must be used solely for its intended purpose as self-catering holiday accommodation.

You must not use the property for any illegal, dangerous, offensive or excessively noisy activity or behave in a way that causes a nuisance or disturbance to neighbours or other guests.

Miner’s Cottage and Damson Cottage are in peaceful locations, and we ask all guests to respect our neighbours and the surrounding area.

Excessive noise that can be heard outside the property after 9:00pm is not permitted.

There is no smoking anywhere inside the cottages.

REFUSE COLLECTION

Guests should follow the refuse and recycling instructions provided at their individual cottage.

Please ensure all rubbish is placed in the appropriate bins or collection area before departure.

LIABILITY

We shall not be liable for loss or damage to you, your party or your property unless it is demonstrably caused by our negligence or wilful misconduct or that of someone for whom we are legally responsible.

Guests are responsible for taking reasonable steps to safeguard themselves and their belongings during their stay.

DAMAGE AND BREAKAGES

We understand that accidents occasionally happen and take a sensible approach to minor breakages.

Please inform us of any damage or breakages as soon as possible so that we can put things right.

You are responsible for the cost of significant damage, replacement, repair or additional cleaning caused by you or members of your party.

This may include damage to furniture, furnishings, fixtures and fittings or additional cleaning required because the property has not been left in an appropriate condition.

GOOD HOUSEKEEPING BOND

Prior to arrival, you may be asked to pay a £150 Good Housekeeping Bond by bank transfer.

We ask that you look after the cottage and its contents as you would your own home and return it to us in the same condition as at the beginning of your stay.

Reasonable costs resulting from damage, lost keys, breakages or additional cleaning may be deducted from the bond.

Where costs exceed the value of the bond, the additional amount may be invoiced separately.

Where no deductions are required, the bond will be refunded by bank transfer within 7 working days of departure.

RIGHT OF ENTRY

We retain the right to enter the property at reasonable times where necessary for inspection, maintenance, repairs or emergencies.

Where possible, we will give you notice and minimise any disruption to your stay.

WI-FI

Wi-Fi is provided for guests’ reasonable and lawful use but does not form part of the booking contract.

If the service becomes unavailable due to a local outage, provider issue or another circumstance outside our control, we will make reasonable efforts to restore it but cannot accept liability for loss of service.

STREAMING SERVICES

If you sign into your own streaming services using a television or other device at the cottage, it is your responsibility to log out before departure.

We cannot accept responsibility for subsequent access or charges if you remain logged in after your stay.

COMPLAINTS

We want you to enjoy your stay. If you experience a problem during your holiday, please contact us as soon as possible so that we have the opportunity to resolve it during your stay.

GUESTS BRINGING DOGS

One dog is welcome unless otherwise agreed with us in advance.

Dogs are not permitted in bedrooms or on furniture and should not be left unattended in the property.

Guests bringing a puppy should take particular care to prevent damage to furniture and furnishings.

We do not supply dog beds, blankets or towels for drying dogs, so please bring these with you.

Please remove excessive dog hair before departure.

If additional cleaning is required as a result of a dog staying at the property, we reserve the right to charge a £50 additional cleaning fee.

DATA PROTECTION & PRIVACY

Personal information supplied through our booking forms, website or by email will be treated confidentially and used for the purposes of administering your booking and communicating with you about your stay.

We will not disclose your personal information to third parties except where necessary to administer your booking or where we are legally required to do so.
